Primary care staff to retain terms and conditions if they transfer to CCGs

Primary care trust staff who transfer to clinical commissioning groups (CCGs) will keep their existing terms and conditions, it has been confirmed by health minister Simon Burns in a letter to the Financial Times (19 April 2012). However, he writes: “CCGs will retain the flexibility to offer non-transferring staff terms and conditions other than Agenda for Change. In addition, CCGs like any other employer have to adhere to existing employment legislation, including TUPE [transfer of undertakings (protection of employment)] where applicable.”
